Terms of Service

1. Acceptance of Terms

By accessing or using the CarPhotoWizard.UI.com website ("Platform") and its services—including listing enhancement, AI-powered image processing, video post-generation, and related tools (collectively, the "Service")—you agree to be bound by these Terms of Service. If you do not agree to all terms, do not use our Service.

2. User Accounts

  • You must create an account using a valid Google OAuth identity to register and use the Platform.
  • You are responsible for maintaining the confidentiality of your account credentials and all activity under your account.
  • You must provide accurate, current, and complete information during registration and update it as necessary.
  • We reserve the right to suspend or terminate accounts that violate these Terms, including but not limited to: fraudulent activity, abusive behavior toward other users, or attempting to circumvent platform rules.

3. Eligibility

  • You must be at least 18 years of age to use this Platform.
  • If you are using the Platform on behalf of a business entity, you represent that you have authority to bind that entity to these Terms.

4. Platform Content & Listings

You retain all ownership rights in your submitted content (vehicle images, descriptions). However, by uploading content to the Platform, you grant CarPhotoWizard a worldwide, non-exclusive, royalty-free license to:

  • Process, store, reproduce, and modify your content for the sole purpose of providing enhanced listing services
  • Distribute enhanced images back to you as part of the Service
  • Use anonymized, aggregate data derived from your listings for service improvement and analytics purposes

5. AI-Generated Content & Output Rights

All images, descriptions, videos, and other content generated by our AI models ("AI Output") are delivered to you for your personal or commercial use related to selling or marketing the specified vehicle. You may not:

  • Resell, redistribute, or license AI-generated listings as your own stock imagery
  • Use AI Output in a manner that infringes upon third-party intellectual property rights
  • Attempt to reverse-engineer, decompile, or extract the underlying AI model weights or training data from any AI output

6. Intellectual Property & Platform Rights

The Platform—including its design, code, logos, trademarks, and proprietary technology—is owned by CarPhotoWizard and is protected by intellectual property laws.

  • You agree not to copy, modify, distribute, or create derivative works from the Platform without prior written consent
  • Our trademark "CarPhotoWizard" may only be used in contexts we explicitly approve (e.g., testimonials with attribution)

7. Payment & Refund Policy

All payments for subscriptions, credit packages, and premium features are processed securely through Stripe.

  • Billing: Subscription fees are billed in advance at the frequency specified (monthly/annual).
  • Credit Consumption: Each AI task (image enhancement, video generation, etc.) consumes a specified number of credits deducted from your balance.
  • Refunds:
    • Subscriptions: Cancel anytime; no partial refund for the current billing period. You retain access until the end of the paid period.
    • Credits: Credits purchased are non-refundable once used. Refunds for unused credits may be issued at CarPhotoWizard's sole discretion within 14 days of purchase and upon manager approval.

8. Prohibited Use & Content Moderation

You are prohibited from uploading or submitting content that:

  • Depicts, promotes, or facilitates illegal activity, including fraud, theft, or counterfeit goods
  • Contains hate speech, discriminatory language, or content targeting individuals based on race, religion, gender, orientation, disability
  • Includes sexually explicit material, obscenity, or non-consensual intimate imagery
  • Infringes upon another's intellectual property rights (trademark, copyright, right of publicity)
  • Invites spam, phishing, or deceptive practices (e.g., fake listing prices, impersonation)
  • Contains malware, viruses, or any code designed to harm the Platform

Moderation & Enforcement

We employ a multi-tier content moderation system:

  1. Automated Pre-Scan: All uploaded images and text descriptions pass through AI-based screening for prohibited content before processing.
  2. User Reporting: You may flag or report any listing via the "Report" button on the listing page. Each report is reviewed by our moderation team.
  3. Manual Review: Flagged listings and suspicious activity are manually reviewed within 24 hours.

Possible Actions include:

  • Removal of the offending content
  • Temporary suspension of account privileges (warning)
  • Permanent account termination (repeat/severe violations)
  • Referral to law enforcement (in cases of suspected criminal activity)

9. Limitation of Liability

To the maximum extent permitted by law:

  • CarPhotoWizard provides its Service on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied
  • We do not guarantee that AI-generated outputs will be error-free, unbiased, or suitable for your specific use case
  • In no event shall our total liability exceed the amount you paid to us in the 12 months preceding the claim
  • We are not responsible for indirect, incidental, or consequential damages arising from your use of the Platform

10. Termination

We may suspend or terminate your account at any time, with or without cause, with reasonable notice (except in cases of severe violations where immediate termination applies). Upon termination:

  • Your access to the Platform will be revoked immediately
  • You may request deletion of your personal data within 30 days
  • All unpaid fees become immediately due and payable

11. Dispute Resolution & Governing Law

  • Governing Law: These Terms are governed by the laws of Canada, with applicable provincial laws where relevant.
  • Arbitration: Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the ADR Institute of Canada. The arbitration shall take place in [City, Province].
  • Class Action Waiver: Disputes must be resolved on an individual basis—not as part of a class or consolidated action.

12. General Provisions

  • Changes to Terms: We reserve the right to update these Terms at any time. Continued use after changes means acceptance of new terms.
